The "No refusal weekend" requires the officer to obtain a warrant if a DWI arrest is made and the individual refuses a breathalyzer test. If probable cause does not exist then the arrest probably would not have been made and the judge will not sign the warrant. If you think obtaining a warrant is based on probable cause is a violation of your 4th Amendment right, then go back and read it. The easy solution is don't drink and drive and don't tolerate other doing it.

Ok, here's the deal. What this is if the police suspect you of DWI they can get a warrant, based on probable cause and take your blood in order to test it's alcohol percentage. The blood is taken by a registered nurse, not the police officer.The warrant is first reviewed and signed by a judge, who determines if the officer has probable cause to take the blood. An officer can do this any day of the week, not just on "No refusal weekends."

Here in Wyoming they just passed a law stating anyone suspected of driving under the influence must submit to a breath blood or urine test. Yeah my rights went out the window and ill blow in your little breath machine but if a cop tries to stick me with a needle there is going to be problems.

if a judge signs a blood draw warrant your blood will be taken.....period, no violations of rights--its a warrant just like a search warrant given then your car/home is searched
its that simple, follows laws and constitution, some people are just too ignorant or stupid to understand, others are just against the law being enforced, I was almost killed by one, I say good job

It doesnt matter what Ms Hitler says about what the law provides and doesnt provide. The law will be enforced at "police discretion" just as it always has been. They want to coerce you to plead guity, make false charges, harass you, assault you, lock you up, rape you, they will.

The fact is police can do whatever they want whenever they want. The law says this, the law says that. Many of you clowns out there break the laws yourselves then profess innocence. Guess whatr clowns? Then police also break laws. And they lie. Who is going to force the police to be ethical with those needles? NOTHING is stopping cops from pulling you over for any reason or no reason at all. Fools gonna believe police "discretion?" Just because pigs tell you that they saw this or that doesnt mean theyre telling the truth. Enabling needle laws makes it easier than ever to jab you repeatedly, shove the needle all the way thru your vein, threaten your daughter with the needle if she doesn't plead guilty or "constent" to whatever mr police officer desires. You are a pack of fools.
No one rights being violated???? How about you cannot be compelled to be a witness against yourself? How about the 4th Amendment right to be free from unreasonable searches and seizure? This is the most gutwrenching police action I've ever heard. Roadblocks and forcible extraction are things associated with regimes we struggle to disband. That our own police would perpetrate so many constitutional rights violations is unconsciounable!
Be careful, proponents, not to let your guard down. These rights violations affect everyone, not only those from whom you seek protection. I find the degree of complacence here equally as disturbing as the affront.
