Any amendment passed by congress by laws set by the constitution IS CONSTITUTIONAL. If I lived during this time.. I would of been happy to impeach, convict or shot the traitor Andrew Johnson myself.

The extra democrat representation that was apparent after killing the 3/5 compromise is perhaps the main reason that the south was denied representation in congress.
Not defending the southern democrats here, but this video makes absoutly no mention about the unconstitutionality of the civil rights bill at the time. The right to decide who votes and who is entitled to what civil rights was up to the state governments. Even some of the radical republicans admit this. If this were not true, it was unlikely that the fourteenth amendment would be necessary. Furthermore abolishing slavery destroyed the 3/5 compromise giving democrats extra representation.

The civil rights bill was declared unconstitutional by the supreme court 10 years later.
