Texas Board Certified Criminal Defense and DWI attorney Stephen Hamilton says that an officer cannot force you to take a breath test. Instead, the officer will read you what are called the "statutory warnings" which says that you have been arrested for DWI and now the officer is asking for a sample of your breath.
Then the officer will tell you what will happen if you do not give a breath test. Sometimes an officer will make promises to you or even make threats if you do not give a breath test. Watch the video now to learn more about what to do when asked to give a sample of your breath.
