Constitutional rights violated in Texas court - audio
Date of incident: 29 Jun 2011
Just so it's clear here are the lists of rights violated:
6th Amendment rights: Right to demand the nature and cause of the charges
Art 1 Sec 10 of Texas Constitution: Right to demand the nature and cause of the charges and challenge the plaintiff
Right to challenge personal and subject matter jurisdiction
Art 1.051: Right to counsel (can only be waived in writing and court has to advice me of the consequences)
Art 1.052: Plea has to be SIGNED, and in good conscience
Art 1.12 Right to a jury
Art 1.13 Jury can only be waived in writing
Art 1.24 Proceeding have to be public (It never was, I was called into a room)

There was never a plaintiff or a prosecutor. Judge acted as both. A gross violation of the separation of powers doctrine.
My motions were denied without there ever being an objection by the prosecutor.

And if you're one of those people who say - it's just a speeding ticket, go fuck yourselves. Does it make a difference if it's a speeding ticket or a murder trial? Does it make a difference if you steal a dollar or a million? It's a matter of principles, which you probably don't have any.

  • I hope you take your traffic ticket to trial jury (which you have the right to do and that judge did grant that right) and when you are found guilty they sentence you to the maximum penalty (which is I hope $1000 fine and 1 year in jail) because someone needs to pay for your stupidity.

    You signed your so called rights away the minute you signed your drivers license or did anything for profit and the judge can pretty much do what ever he wants to the persona, your using, with immunity. If you try to breach that immunity by raising some sort of hell, you will probably smart for it.

  • @qui3tude Driver's license is not a contract and even if it was, I didn't sign away my rights.

    It's a criminal charge, as he himself stated. Why did you think I made him say that? You have rights in all criminal procedure. Rights are not something to be taken away at an arbitrary whim

    Rule of law and court procedure have to be followed.

    Can people who have no idea what they are talking about, stop commenting on this video?

  • @tjohn1986 You choose not make a plea. Its that simple. The judge gave you what? 3 Chances to make a plea? If you are a lawyer, then please school me on Texas Law and cited.

  • @movcrit That's not how it works. The court has to establish jurisdiction long before it can enter a plea. Read the description.

  • Ignore these compliant kats on here.Once a judge makes a ruling on a motion then you have to appeal that decision,dont stand there & argue with him about it;you are making your verbal argument in a court of no record.stick to the point & if you are denied then appeal on that basis immediately.u have 2 escalate & stay on point. Oh & no prosecutor means no prosecution, anything else is unconst.I dispise right depriving laws.My property & my easement leave me alone unless I commit an actual crime

  • Jurisdiction can be challenged at any time, You should have told the Judge that you accept his offer to be surety for the defendant, and to defend the defendant.

    It is amazing what we don't learn, Our worst enemies are ignorant people, Those who refuse to see. Good luck, I would countersue immediately for damages.

  • You were being a smartass. You were wasting the courts time and resources. The judge called your bluff. You're probably lucky you weren't cited for contempt.

  • The judge lied. Traffic violations are NOT criminal. That is why you can get a CIVIL FINE. Sue the judge, you have all the evidence you need.

  • MAN THIS JUDGE IS SO CURROPT. I can't believe he forced you to plea not guity when you didn't submit a plea. Now you have to go to the actual trial for your speeding charge. Its the end of the world. Human Rights are no longer protected!
