Pennsylvania Wiretapping Law

The law does not cover oral communications when the speakers do not have an "expectation that such communication is not subject to interception under circumstances justifying such expectation." See 18 Pa. Cons. Stat. § 5702 Therefore, you may be able to record in-person conversations occurring in a public place without consent.

  • A public officer on public property can not "expect privacy" and therefore does not need to consent to recording in a "two party consent" state, like PA. Not sure how obvious your camera is but you should always (just to CYOA) say that you are recording. If he chooses to keep talking and make threats behind the cover of authority, well, that then falls on him. There are several ways of consenting to be recorded without saying "I agree to be recorded".

  • I understand the position of these teenagers, but they need to understand antagonism isn't the goal. The goal is to abide by the law, be respectful, and catch unlawful police activity. Commenting on his temperament is pointless, it only serves to antagonize. In that regard, you'll always come away looking like the asshole, no matter how he reacts. Take his warning, which was legit, move, and keep going. If he does something illegal, capture it on video. Simple.

  • Welcome to the police state. Federal regulations state to get funding for these criminals in uniform they must have an IQ below 100. I believe this criminal's IQ meets the regulation by quite a bit.

    I call my congressman several times a week to state my views on what they are doing and I suggest you do too as it is the only way we can get any action. Every phone call is considered to be 1000 people, a personal visit 10,000.

    We need to swamp their phones everyday, they think we are asleep.
