Greetings Judge Stow:

You will soon be hearing a case about a young Deaf girl whose body is not her own. Her father, paternal grandparents and other family members are mandated to make the child wear bilaterial cochlear implants against her will throughout her day. Her body is not her own.

Case laws have already determined that being Deaf does not prohibit people from living full and happy lives (see 29 U.S.C. Sec. 701(a)(3)) and notes that no one should be forced to accept a certain accommodation
Americans with Disability Act 42 U.S.C. Sec. 12201(d)

Personal Liberties and Privacy are being threatened with this case (see Pierce v. Society of Sisters and Meyer V. Nebraska). The United States of America was founded on the principles that "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness." The cornerstone of our democracy was laid out in the Declaration of Independence and later reinforced with the 14th amendment. Emma has commited no crime unless one considers being Deaf a crime and thus her life, liberty and personhood should not be violated against her will. Cochlear Implants are controversial devices that require invasive surgery and are often implanted without the consent of the child and in this case the consent of the biological father. Cochlear implants have proven to cause physical harm and even death in some cases.

Please rule in favor of this child's right - please protect her civil rights and her human rights as well as the rights of her father. This letter has been sent to all parties involved.

I remember when I had hearing aids on, I took em off whenever I had bad headaches!!! I do not want to wear them whenever I had big bad headache!!! I feel bad for the child!!!

Popemistress - even the FDA warns about if child is resistant to wearing CI or crying in pain - do not have them wear it.

can judge bend to popular opinion ?? i dont think so...but lawyer can appeal judge's decision to higher court...lets raise legal fund to appeal to prevent adverse precedent !
