I know i figured out the hard way when i was arrested for disorderly conduct, Assault, Endangering the public, and destruction of mta property. I said " but there's a lady playing a saw, i'm just expressing myself artistically. Isn't that protected in the first amendment?" it's this whole big convoluted mess that neeeds to be sorted out at the supreme court . My claim: i'm innocent on the account i was playing FFF x3 w hand grenades and 128th note burst w/ the machine gun.
