Kim Schmitz only created Megaupload as a FILE SHARING website, he cannot be considered responsible for people who uploaded copyrighted content. It's like if you're the owner of a parking lot and someone shows up with a stolen car, then you're the one who gets arrested. It makes just-as-much-sense.
