You just had surgery and developed complications that required additional hospitalization or another surgery to fix the problem. You are angry. You are outraged. You were told that this would be a routine procedure. How could this happen?

You believe that simply because you developed a complication following your surgery, that automatically means that something must have been done wrong.

While that may occur in some instances, the majority of time the fact that you have suffered a complication following a surgical procedure does not, in and of itself, mean there was a departure from good and accepted medical care in New York.

The fact that an injury occurs during or following surgery usually is not where there is a basis for a case. Most typical malpractice cases arise when there is a failure to timely diagnose and recognize your intra-operative injury. That is typically what gives rise to the departure from good and accepted medical care.

Having said that, there are still instances where the doctor will raise valid defenses to explain away why it was difficult if not impossible to recognize your particular injury.
