Part 1 - The Battle for Same Gender Marriage Continues

11/5/08 Today Gloria Allred and her law firm filed a writ with the California Supreme Court challenging the constitutionality of California Proposition 8, which is an attempt to restrict marriage to couples consisting of a man and a woman. In the lawsuit filed on behalf of Robin Tyler and her spouse, Diane Olsen, we contend that excluding same gender couples from marriage violates the equal protection clause of the California constitution. This is part one of a two part video.

Ms. Allred:In Nebraska Section 29 of their constitution adopted by voter referendum in 2000 much like Prop 8 in California, provides that only marriage between a man and a woman shall be valid or recognized in Nebraska. The holding in Citizens for Equal Protection, Inc. v. Bruning 4:03Cv3155 (D. Neb. 2005) struck down Section 29 of Nebraskas constitution. Is the precedent set here applicible to prop 8?

Its only this "narrow" because there were so many bogus government officials trying to get in the way. People like Jerry Brown changing the name of the ballot measure. People like Diane Feinstein, State Superintendent of Schools, etc., all getting in the middle of it, when they are supposed to just SERVE, not DICTATE to us.
