Constitutionally protected rights & privileges can also be trumped. Ex; the impending adoption of UN law regarding small arms & 2nd Amendment. Also international law inhibits the engagement of non-gov forces in many conflicts; citizens and guerilla forces in conflicts are non-combatants (as defined by UN law), and are disarmed, and the UN is responsible to them - we can see in Africa how successful that has been (considering the despotic regimes supporting the 'right' of only Govs to be armed).

pre-emptive war is hitler's invasion of poland. a simple concept. the other is weapons of mass destruction pretext, particularly when the accuser was the sole supplier of the weapons to the country's invader.
