No, according to his affadavit she was in bed asleep when he went onto the balcony where he closed a window and collected a fan which was running there. When he came back into the bedroom he heard noises down the corridor, assumed she was still in bed asleep and took his gun to investigate further. He also said that they had exchanged sides of the bed because he had a shoulder injury. She had presumably been woken by him getting out of bed and decided to go to the bathroom.

There is no question as to Pistorius's guilt & hopefully open & impartial court proceedings will confirm this. The question now lies with the South African's judicial system & it's ability to deliver justice for Reeva & her family...to confirm the guilt of the one who took her life. If his being granted bail is any indication of this, then there is cause for concern.
