Bashed Wife loses her Pre-Nuptial Agreement

Mrs Black went to her lawyer. She was about to marry a handsome chap by the name of Mr Black. However, she wanted some protection in the unlikely event that they ever separated. (It was a second marriage for both of them.)

She didn't want to think about breaking up. This is just like how no one wants to think about dying. However, people take out insurance to protect their family if they die. Similarly, she entered into an agreement with her dashing companion. This removes the pesky Family Court from interfering in her private affairs. It also gives her certainty in case they break up.

Hi Brett how long does a partner have to live with you until they are entitle to assetts.

I have heard two years and after two years are they entitle to haft your asserts.

In most states of Australia you are in a defacto relationship after 2 years (or less if you have children or share money and buy assets together). However, you need to be married or in a defacto relationship for 10 years plus to start losing ½ your assets.

If you are only boyfriend and girlfriend you may not be in a defacto relationship. There is a definition on this term.
