Whoever has the biggest stick. You'd have nothing to base a claim on any rights you think you have, other than human decency--but that argument would just boil down to moral relativism (e.g., Hitler didn't think Jews deserved rights, so who were the Jews to disagree with der Fuehrer?). Rights would then just come from whomever has power over you (who you may hate). This is why atheism sucks, and it's important to maintain that our rights do in fact come from God/Nature and not from government.
