This is a response addendum to a vid by HappyCabbie ( vid here : http://www.youtube.com/watch?v=dT1zSS51V40&NR ) He talks about DMCA, and counter-filing a claim.

I want to add an addendum to his video, as there are dangers in counter-filing. Youtube's system is completely messed up in that the burden of proof is on the accused, not the accuser. Plus the accuser can, and often does, remain anonymous. This leads to problems.

  • So, Youtube made a system where whoever files a DMCA claim can basically get a video taken down immediately, and whoever they filed the claim against is forced to submit their personal information to them... And they didn't foresee these problems??

  • @CheezeFox In so many words, yes on all fronts.  And apparently, they continue to not see a problem with it.

  • @HappyCabbie The only problem is that I don't know where to go from here, to get youtube to change their DMCA policies. I would prefer to change the DMCA at it's base, the law needs to be changed drastically. But i'd settle for youtube changing their method of dealing with it for the short term. Prevent a LOT of problems with DMCA abuse.
