This course concentrates on the history, considerations, and
methodological principles of jurisprudence in Sunni Islam.
It describes the origin and development of Islamic legal
theory and the legal schools of thought within the orthodox
tradition and the need for a broad-based approach to this
Islamic heritage, especially in the modern world.
Course Objectives:
- Meaning and function of Fiqh .
- Origin and development of Islamic legal theory.
- Revelation and reason, and the divergent schools so produced.
- The lives, works, and key contributions of the founders of the major legal traditions.
Learning Outcomes:
- Define fiqh and usul al-fiqh and distinguish between them
- Historical development of madhahib .
- Explanation the Islamic legal rule (al-hukm al-shar'i)
- Explicate various sources of Islamic law
- Discuss modern trends on the questions of ijtihad and application of maqasid al-shari'ah.
