Brian wants Gov all up in every bodies shit. If a law was broken then there are already enforcement in place. Government has no right investigating individuals.

Congress has no business investigating baseball. First of all baseball is a non contact sport these players are doing nothing more than hitting a ball, if congress is going to investigate a sport shouldn't it be a contact sport like football? Bush started this whole topic to get people's mind off the war and the media just ate it up! Congress writes laws, baseball players play a child's game, NOW WHO SHOULD BE TESTED FOR DRUGS!!

Congress is sticking it's nose where it doesn't belong once again. Who cares if these guys used Steriod? MLB knew about it and it wasn't illegal. Congress should worry about our Irag vets getting treated like crap when they file their disability claims and this economy. This crap simply should not be making headlines. Some one priorities are screw up.

Neither Brian nor the judge addressed what gives Congress the "right" to investigate baseball. Baseball was declared exempt from the Sherman Acts by the Supreme Court in 1922. Only Congress can amend the Sherman Acts to make baseball subject to antitrust laws. Instead, Congress had used the bad court decision to help MLB owners and, as a consequence, have meddled in baseball affairs ever since. That said, the Judge is right in that Congress has no business in baseball. Brian is simply a moron.
The Judge is 100% right. But, what he has to realize it that he is making an argument to someone who is completely ignorant about the Constitution and the powers it confers on the Congress. It is "ENTERTAINMENT!!" as such, Congress, should not even consider wasting money and energy discussing it. These guys are overpaid to entertain, playing a kids games for billions. Who cares how they treat their bodies as long as they don't promote it or do it in front of the kids.

I disagree with Napolitano on things. But he is right on this one. Kilmeade should go back to Long Island!
