Officer Charged With Beating Wife And Child May Strike A Deal

He was sworn to uphold the law, but a former police officer accused of beating his wife and step child faces serious criminal charges.

As the case makes its way through court, the victim's parents hope prosecutors won't be lenient with the former cop.

The Davis County attorney hinted today, there is a chance he'll offer John Spencer a deal to avoid a trial.

Deal or no deal, the victims' family says they want justice.

John Spencer resigned from the Centerville Police Department in May, after he was arrested by officers in Layton.

In court papers, prosecutors allege that after arguing with his wife, Spencer "grabbed his wife's head and slammed it into the tiled floor several times."

And when his 5 year old stepdaughter tried to stop him from hurting her mother, Spencer "grabbed the child by the hair and slammed her head into the tile floor several times"

In court Monday morning, neither Spencer, who's pleaded not guilty, nor his attorney made comments.

The Davis County Prosecutor, Bill McGuire, only said over the phone he could still offer Spencer a deal in exchange for a guilty plea.

"Do whatever it takes to make sure consequences are just," says the alleged victim's father Armando Gutierrez.

Gutierrez is the father of Spencer's wife and alleged victim. He hopes if a deal s offered, the state will not ask Spencer to face anything less than a felony.

Delsie Gutierrez says their granddaughter, still relives the alleged abuse, "to this day, my grandaughter is totally afraid of any police officers that she comes across."

Right now, Spencer is charged with 3 felonies: for child abuse, domestic violence in the presence of a child, and aggravated assault.

Prosecutor Bill McGuire told 2News over the phone that if he offered Spencer a deal a felony charge would almost certainly be part of that.

Spencer's attorney says he can't say much until the case moves on.

    A former Centerville police sergeant was sentenced to a year in jail today for acts of domestic violence committed last year against his wife and step-daughter... At a review hearing set for October, Memmott said Spencer could receive work release for employment and treatment. The victim, Jeanene Spencer, and her parents complained after the hearing that the sentence was too light...

  • Normally i don't let crass comments through but in this case...

    As long as the comments aren't directed at all officers - just Spencer.

    Does he fight men or just women and little girls?

  • @melisscali Im sorry that happen to you. keep speaking out at least online so this topic will never go away. I too im a domestic violence survivor. Nobody wants to admit that most men are violent and guess who dominates the law enforcement team and goverment, MEN. I think 90% of men have been violent against women at some point in time in there life

    what? I had my head bashed in and my phone trashed I was out for a week and they treated me like the criminal, even with witnesses and pictures of what he did, Orange County DA in Newport decided to let him off. Treated me like a horrible person. Practically took his side. I was told by a cop if I died I would have a case---justice
