QUESTION: I understand that Division 6AA taxes minors at a 66% tax rate. However, I heard that under section 102AG disabled children can be taxed at an adult tax rate. My son suffers from Autism. What do I need to do to get that adult tax rate for him?

Is it just a matter of forming a Trust for him? Or does my son or Trust have to invest funds in satisfaction of a claim of damages? Who do you sue for damages for Autism?
