I'm a drummer believe me I know 16th v 1/4 note notation! I think my confusion is over what PART in bar 38 I'm supposed to be looking at? I guess naturally I went to the bottom (part IV). Perhaps that's my mistake?

Ok I see where the confusion was, yes you were looking at the bass lines - sorry about any miscommunication, I was not really sure what you meant but now it is clear.

All we are doing here in these lessons is concentrating on the 1st Violin (guitar in this case) part.

Although in the "part 1" lesson I cover the bass lines and guitar chords with a bit of fundamental theory.

Awesome lesson dude. I really like the video overlays and your pace is pretty good for me. I guess some of the instruction vs the guide confused me. Like at 2:47 it says "the last grouping in bar 38 of 16th notes.." but I look at bar 38 and it seems to end in 1/4 notes? Proably i'm just confused about something.

Yes, the pickup notes are sixteenth notes - if you look carefully you will see 2 beams which does in-fact denote sixteenth's.

1 beam = eighth notes

2 beams = sixteenth notes

3 beams = 32'nd notes
