There is no sovereign guarantee on the depositor's scheme according to the EU directive says Alain Lipietz who chaired the Finance Committee of the Parliament of Europe which wrote the directive. It is very clear in the directive that it is the responsibility of the host country (i.e. UK and Netherlands) to make the bank participate in the local host state depositor scheme if the home scheme doesn't have sufficient funds. Therefore, the British and the Dutch have to pay for the depositors in those countries, alternatively if they don't like it they can settle this in the European Court of Justice.
