Wickard v. Filburn greatly increases the ability of congress to regulate interstate commerce. Filburn was growing excess wheat which congress said affected the interstate wheat market using the aggregate effects test. This eliminated states ability to regulate production using intra-state commerce, and basically only the Cooley doctrine determines when states can regulate interstate commerce. Congress has an enormous amount of power, and Wickard v Filburn will make it hard for the courts.

i heard the the civil rights act of 1878 was repealed because the supreme court ruled the the cogress could tell the people what to do so wch is ? can they tell the people what to do or not?everyone is always saying that the founding father wre thinking this they were thing that i say they were thing we just killed a bunch of limies who government is facist rather than commie and we wheren't going to have that any more.wich means limited gov.not people .this is unquestionably true

@Foreverclever87 The problem I have with Wickard is the ensuing interpretation by later courts. The law being challenged by Wickard recognized that a certain amount of wheat for personal use was not subject to regulation by the commerce clause. The substantial effects clause was only intended for fungible commodities. It's now a power to ban anything outright. That's beyond regulation. Once products are in private possession, commerce has ended and so should federal regulation.

@Foreverclever87 Then your law professor is an idiot. Nobody in their right mind who ratified the constitution would ever think that the government could do this. They were changing the law from the bench. The ruling changed what the law meant.

While I agree everyone should read the case you'd have to be some kind of a grade-a moron to think the ruling should have been anything but 8-0 against the government.
