My property is NOT correctly identified by the term "motor vehicle". It is correctly identified by the terms: "personal property", "consumer goods", "personal chattel". I DO NOT use my property for COMMERCIAL purposes when I go from Point A to Point B. I do NOT get compensated/paid when I "use" my property to go from Point A to Point B.

The activity licensed by state DMVs and in connection with which individuals must submit personal information to the DMV - the operation of motor vehicles - is itself integrally related to interstate commerce.

Sec. 31. Definitions When used in this chapter the term - ''Motor vehicle'' means every description of carriage or other contrivance propelled or drawn by mechanical power and used for commercial purposes on the highways in the transportation of passengers, passengers and property, or property or cargo;

California Vehicle Code 15210 (p) (7) In the absence of a federal definition, existing definitions under this code shall apply.

Because there IS A FEDERAL definition that's the one we're required to use.

  • Private -Not for Hire. If you aren't engaged in commerce you have a RIGHT to travel in your car (not a motor vehicle) with your "guests" not passengers. When you are a paying customer on a plane, train, ship you are a "passenger"-get it. Rights can't be taxed, they are RIGHTS. Go back to school RetSquid or just admit the government pays you to be a disinformation agent.

  • @EX208REV1214 Thanks for the confirmation counselor. You've never represented yourself in court as a MAN or PERSON and if you have YOU LOST. Do you know how many definitions of the word PERSON there are? And are you referring to the definition PRE 1866 or POST 1866? Let's approach it this way, I'm a MAN and one of the PEOPLE, now what asshole? See Cal Govt Code sec 100, 181, 11120, 54950, where for some odd reason the Legislature didn't use the term PERSON or PERSONS. Gee, I wonder why?

  • @drivingiscommerce Haha, when you go to court your not representing yourself to begin with. Your representing a person, not a human being. Looks to me you still need to understand things. Looks up the difference between a legal person vs a natural person.

  • @EX208REV1214 I think you ought to spend more time studying contract law. I really don't understand where people like you come from. I'm familiar with Stevens and his work. I dunno how many times you've represented yourself in court but it's clear to me it ain't been much and you lost when you did. Just study the rules, presuming you're able to locate them.

  • @drivingiscommerce I think you need to check out some of marc stevens stuff. No you do not need a license to do business. Do you understand what constitutes a crime? Lets say you do have a license and all that stuff, your caught speeding 100 in a 50. It is not a CRIME to speed. No one rights have been violated and there has not been any damages or injury to people and the ticket will be thrown out if you know what to say. To say you need a license to do commerce is missing a big step.

The court of Appeals and Supreme courts both State and federal TELL US THE HISTORY of stuff and HOW TO DO THINGS TO PREVAIL and how people blow their own feet off and why. FindLaw.com is a TREMENDOUS FREE RESOURCE. They provide access to BOTH State and fed COURT CASES which CAN BE DOWNLOADED!

In addition to Webster's dictionary, there's also LAW DICTIONARIES. Now which one do you suppose the Legislature uses when making LAW?

  • @EX208REV1214 DRIVING = BUSINESS. You have the UNALIENABLE RIGHT to USE your property for NON-COMMERCIAL TRAVEL and HOUSEHOLD purposes and your ENJOYMENT. You have the RIGHT TO CONTRACT as well. If you DRIVE THEN YOU BEST GET YOUR ASS OVER TO THE DMV AND GET THEIR PERMISSION because DRIVING IS A STATE GRANTED TAXED & REVOCABLE COMMERCIAL PRIVILEGE. I USE my property, I DO NOT "DRIVE" IT. "DRIVE" has a TECHNICAL/LEGAL DEFINITION in addition to the common definition EVERYBODY uses.

  • @drivingiscommerce Im with you BUT, if your making money driving doesnt mean you NEED to get a license. There are no elements to the valid cause of action they bring against you. If you didn't violate anyones rights, or cause damages or injury then it is not legally a crime.

  • @drivingiscommerce I was not questioning the legal concept you are following, rather the mechanics. If someone was to purchase a car from a dealer, the question I asked, would have had to be dealt with. The information you provided in your description is very clear on this point. In this case, federal definition controls. And yes I agree, driving is commercial, while traveling is personal. You are to be congratulated on your success.
