Mehserle is to blame for whether his actions were intentional or unintentional. I believe his sentence, 2 years, was a political gesture: Cops' aggression ought to be used with more deliberation than reaction. Even though Grant's behavior (loosely) met criteria for further restraint, the police over-reacted. In my experience, it always pays to listen to cops' orders b/c cops make mistakes, too. It seems stupid to provoke cops as they already take every situation to possibly be their last.

Resistance is often escalates into lethal violence, but it appeared Grant's resistance was provocative and merely very obnoxious, though not violent. Officers are to quell any potentially dangerous situation, so a few mistakes occurred: M misplaced his taser. G resisted. The resistance vs subduing escalated. G was shot.
Mehserle had been carrying a yellow taser in his hand while the group of fighters were seated on the ground. Grant was acting defiantly while officers were attempting to subdue the young men. Grant struggled/resisted against the 3+ officers subduing him. Officer Mehserle stated he was going to use his taser, though his taser is no longer in his hand after the scuffle. Grant was then gunshot instead of tasered. The debate here should be whether Mehserle mistakenly or intentionally shot Grant.
