He didnt write this song that's why he won't try it in court. He actually stole the song from a colledge roomate who sang it in the shower. Don't believe me? Go look up: "Coldplay & Creaky Boards vs. michael" and see for yourself.

i personally think these songs dont sound similar enough to make an argument. maybe the tone of their voice and pace is similar, but the melody is way different
