The drummer for Badfinger said the surviving members of Badfinger considered suing Jackson over the similarity to their song Day after Day.

It would have just like Joey Molland to sue someone over something he never wrote...Pete Ham who was deceased by the time this was released was a reasonable man. I think if this would have gotten to the point of litigation, Pete Ham and Joe Jackson would have been able to work something out
