David Hicks' Control Order not to be renewed!

Thurs, 20 November 08

On the 21 Dec 08, the current control order in respect of Mr David Hicks expires.

Following extensive consultation with a number of agencies, the AFP has decided it will not be seeking a further control order in respect of Mr Hicks.

The AFP has today advised the Attorney-General and Mr Hicks legal representative of its position.

The AFP will not be making any further comment in relation to this control order process.

Not sure about your comments on charges being unused for that long. But he would have been found guilty of "intent" if he was caught the same way in Australia. No doubt George W made his own rules but the world changed forever on 9/11. Also, it is a new phenomenon for Australians to be fighting against our own citizens. And, yes, I possibly would have pleaded guilty to get out of prison. But I would also have the guts to tell the world the truth about what I was doing. Too traumatized my arse.

So he's guilty if the Taliban were enemies of the Commonwealth at the time! (note, by contrast, that it is not necessarily a crime for an Australian to fight against the US, which explains the constantly shifting charges brought against Hicks there).

And don't forget, there are laws preventing forced confessions in Australia!

So is attending a training camp assisting? Is associating with know terrorists assisting? Is being caught with weapons etc assisting? You call me un-Australian? I'm not the one who trained with al Qaeda. Hicks sure has you fooled which is sad as he really is a dim wit. "Too traumatized" to tell us why he was there and what he was doing? What a wanker. RICHMOND, Va. - The Bush administration cannot use new anti-terrorism laws to keep U.S. residents locked up indefinitely without charging them, a divided federal appeals court said.
To sanction such presidential authority to order the military to seize and indefinitely detain civilians, even if the president calls them enemy combatants, would have disastrous consequences for the Constitution — and the country, the court panel said.

No argument about that. Interesting however, that you choose to accept the findings of a U.S court only when it suits you. I don't believe that the U.S constitution is adhered to in the spirit that it was intended anyway. Regardless of the charge, Hicks was intending to fight jihad against the west, including Australians.
