The bird will stop rocking once the water is over....the bird gets energy from the temperature differential caused by awater evaporating from its beak....so in short conservation of energy is not violated---- its taking heat from the air to do work

I think the argument you are making is simlar to taking a laser pointer and then saying that the laser point can move faster than seep of light as u turn the laser. the laser point can travel faster but you cannot trasmit information
