I was the pedestrian in an auto versus pedestrian accident. I would like to small claim sue the driver of the vehicle that hit me in the cross walk, to get reimbursed for all the money I have spent (and will spend) as a result of the accident (ambulance, emergency room, time off work, etc.). Should I name him and his insurance company in the lawsuit, or just him? If I should name both, can I send the summons to appear via certified mail and not have a process server serve them? I live in California.

Hello, I have a ex-friend who is saying I got a machine part at my house of his, And he is threatnen me with going to court, I have no Idea what he is referencing this on. I have nothing of his. But, He keeps saying I do. How the world do I tell a judge that I don't have this thing. I am not even sure what the name of this thing is. But he swears I have it in my garage, I even let this ex- freind go into my garage and see if he could find it. I don't know what to do. He says it was worth almost a grand, Geesh for that I should at least get to know what the world it is. What do I do.

A common misconception with people is that a police officer needs your consent to search your vehicle. As I described below, the Supreme Court has ruled that a K-9 is unbiased and incorruptible. She only knows one thing...smell dope! You DO NOT know if your used car was busted in some drug trafficking case. It could have been full of drugs at some point. Even most cash lying in your car does have the scent of drugs. Keep your car clean! I tell every person I know to take a used car that they are thinking of buying and have a K-9 officer do a K-9 search first. They do this for free and it is good training for the dog. The officer gives you a form stating that HE ran this search and it was OK! This is a LEGAL DOCUMENT! But...don't let ANYONE borrow your car for obvious reasons.

I am a former police officer. As far as the traffic stop is concerned, you missed a lot of information. The most important stuff. Let's say I have a used car. I don't know who owned it before me. I get pulled over and the officer gets edgy for some odd reason and decides to WALK HIS K-9 AROUND MY VEHICLE. It's called a K-9 sniff. They close the doors, roll up the windows and turn on the air so it pressurizes the cabin when the doors are shut. ANY air escaping from the cracks is noticed by the K-9. If it "hits" a trained scent, the officer now has probable cause to return your car to you in buckets in search for contraband...on your dime! lesson? Don't talk to police and keep your car clean! The same goes for your house!
