She was stupid for texting, BUT I would think, for liability reasons, a mall would have a barrier around a fountain. HER own negligence caused her to fall into the fountain, but what if that had been a young child who ended up drowning?

He saw the car go around it, the roads were slick--busdriver did his/her civic duty IMO--but, who knows, maybe this 'paved the road' to stardom for him/her & he/she will make lots of money...The driver should get an award CUMTD--Boo on u!
