a guy got a replacement 3ds just because the bottom screen scratches the top screen, I've got that problem too as well as the black screen but it recovers when the battery is empty and works normally, is nintendo gonna give me a replacement system??

With Nintendo 3DS systems, it is normal for the system to have some slight give or play to the hinge. As long as the upper screen "clicks" into place, this is within the quality specification...
