REASONABLE SUSPICION means the following:
1) A person is stopped for a traffic violation, the police asks for a driver's license and the person cannot provide a valid driver's license. This gives police REASONABLE SUSPICION that this person may be in the US illegally.
2) A person rapes a woman. This person is asked for ID by the police but this person provided FAKE ID. This gives police REASONABLE SUSPICION that this person may be in the US illegally.
3) An employer is audited by the state for hiring illegal immigrants. Investigation shows that some of the workers have FAKE SSN cards on file. This gives police REASONABLE SUSPICION that these workers may be in the US illegally.
NO POLICE will just stop anybody in the street and ask for ID. That is a violation of the 4th amendment. People should be able to freely walk in the streets without being badgered by police to show ID. The minute they do that, that is a violation of the 4th amendment.
The Police are NOT that stupid that they will waste their time stopping people off the street because they are brown. They would rather ticket people for speeding than do that.
A lot of the laws are rarely enforced such as the shopping cart theft law, cell phone law, etc. Even if the police sees a person pushing a shopping cart in the street, the police will just IGNORE that person and will not arrest that person. You know why? Because, citing the shopping cart thieves will NOT make the police force any money. The stores do NOT want to testify against their customers. Therefore, the police would rather enforce laws that would MAKE THEM MONEY and it is a sure thing.
If they randomly ask a brown person for papers without reasonable suspicion, they are just wasting their time and money.
The governor said the law will not engage in racial discrimination and racial profiling. The police has to have reasonable suspicion that they are illegal immigrants and they cannot base that on PHYSICAL APPEARANCE alone or race. That is against the law. People should be able to walk freely in the streets without being searched for papers. That is a violation of the 4th amendment.
