If YouTube eventually did that, that act is priceless.
Not kidding.
There was people who got copyright strikes on their accounts basically uploading footage from Call of Duty. If they go to a process of counter-notification, if something goes wrong, they can go to court and get sued.
Of course it is not as frequent as it is on publishing music, but that's how the system works.
I hope you understand it.
By your own logic, he can get sued too. The games he played and recorded to his channel are not his.
