Jhalton : take ur bike back to the dealer. It should not gear up if the kickstand is down. It should slip into neutral when it goes down. Do it before the warranty is up.

Yeah, I took a dremel rotating tool to the thing i used a silver paint marker to draw guide lines and cut along them and polished the whole deal down with a white pad at a rate of like 1000 and it came out sweet. Wish I had video'd it.
