Dual agency comes with many pitfalls and potential risks that real estate licensees need to realize before considering representing both parties to a transaction.
Real estate agents owe certain duties to their clients. Anyone with a real estate license has a fiduciary duty to protect and promote their client's interests, and to deal fairly with all parties to a transaction.

--How Dual Agency Hurts the Seller------
You don't want an agent that finds a "happy middle ground" for both buyer and seller; you want an agent that gets the best deal for YOU. You want to come out ahead. What you REALLY want your agent to do is work hard to ethically and legally find out as much information about the Buyer's side of the transaction as possible, and share this information with you. Some of the Buyer's information you want to know would be illegal or unethical for a dual agent to disclose, yet would be the DUTY of your own agent to inform you. In my opinion, at different points in a dual agency transaction both sides get ripped-off. Dual Agency is just as crazy as having the same lawyer represent both the defendant and the plaintiff in the same lawsuit. You'll never see that on "Law and Order"!!!
Avoid Using a Dual Agent!

A dual agent cannot, by the nature of their contract with the seller, effectively negotiate the lowest possible price for you, and so you may end up paying more than you should, and making concessions to the seller that you don't want to make. Although use of a dual agent must be agreed to by all parties in writing for it to be legal, and although the agent is legally obligated to be fair to all parties, invariably the dual agent will favor the seller.

I found this great information on Zillow.com about working with a dual agent. It is very interesting that I am NOT the only one that feels strongly about working with a dual agent. This is allowed in Georgia and yes even in Thomasville, GA. It is illegal for a dual agent to try an influence a buyer to a particular listing that is listed by the same agent and will benefit the agent or a co-workers listing or keeping the sale in house with the same brokerage.

Dual-agency is the legal term for a situation where the buyer and seller are represented by the same agent in a deal and while it's legal, it's worth avoiding. Last month I looked at an episode of HGTV's The Property Shop that showed just a few of the things that can go wrong because of the conflicts of interest associated with dual-agency.

In Thomasville Georgia you are going to find very few professional builders who built quality custom homes. Most are Realtors, home appraisers or one claiming to be a builder and be working under some one else's license trying to make an extra buck. These people have no knowledge or background on how to build a home and at the same time building below minimum code. These low to bare minimum code homes are being built in Sweetbriar Lakes, Oak Trace, Summer Glen and Shallowbrook subdivisions.
