In February, Allegheny County D.A. Stephen Zappala's prosecution dropped something of a bombshell in the trial of sitting PA state Senator Jane and sister Janine Orie on campaign irregularities. After the jury had begun deliberation, the prosecution submitted a defense document it claimed to be forged. Trial Judge Jeffrey Manning declared a mistrial. Orie Defense Attorney William Costopoulos declared that the prosecution introduced the document in a desperate move because it feared imminent acquittal on all counts. Why would anyone suspect acquittal prior to the verdict? Having attended a pretrial evidentiary hearing, one gets a sense of the intense determination and use of unlimited resources by D.A. Stephen Zappala to convict the Ories over relatively minor campaign irregularities. The effort is out of proportion to the offense and brings into question Stephen Zappala's real motive. This would not be lost on a jury. Railroading defendants in a political trial demands acquittal by jury nullification. Stephen Zappala's relentless determination is reflected in bringing 16 criminal charges, including forgery and perjury, in what is a political retrial. When the Orie mistrial was declared, Repulican State Senate President Pro Tempore Joe Scarnati and GOP Senate Majority Leader Dominic Pileggi issued a joint statement supporting their colleague. "Although we are disappointed this matter was not resolved by this jury favorably, we continue to support Senator Orie throughout this process." In context Sen. Jane Orie and sister Judge Joan Orie Melvin are outspoken critics of gambling while Zappala, a Democrat, has close family members with ties to gambling. Witnesses exist who say that Zappala stated a threat to four public officials, "Anyone who (bleeps) with me or my family, I will indict them,'" The Orie trials exist only because they live in Allegheny County where Zappala has jurisdiction. This is not the first time D.A. Zappala has been implicated in the use of public funds and the misuse of the public trust through prosecution of a political rival. Concerning the prosecution that forced Cyril Wecht to step down as chief medical examiner after indictment by Mary Beth Buchannon in 2005, Wecht stated in January 2010 on KQV radio that Zappala sent Wecht a statement in 2005, 'through an attorney ... that if I was willing not to become the chief medical examiner of Allegheny County then quote, 'All of this will go away', talking about the entire investigation that he (Zappala) had initiated and instigated..." Along with the grand jury indictments of Jane and Janine Orie, the D.A. went to the extreme of having a second grand indict a third sister, sitting state Supreme Court Justice Joan Orie Melvin. If Jane and Janine Orie are acquitted, Judge Orie Melvin will not be convicted. But if Jane or Janine Orie are convicted, the consequences of the Orie political trials could be far reaching and statewide. Conceivably, a sitting Republican Senator and sitting Republican state Supreme Court justice could be removed from office not to mention the personal costs that three Orie daughters could be sent to prison. But the real bottom line for the prosecution is that gambling investigations would be obstructed and those who would conduct them would be intimidated if they live in Allegheny County. Obstruction of gambling investigation is an obstruction of justice. Prosecuting political rivals is thus a great misuse of public funds and the public trust. @@
