Law is a rule of civil conduct, commanding what is right and prohibiting what is wrong. Only when a sovereign state issues rules prescribing what is right and what is wrong can a rule be called a law. For several centuries in England and America, an individual who owned land owned the soil and minerals below the topsoil and the air above the land all the way to heaven. The law prohibited trespassing on a persons land or in his air. A telephone company that wanted to string a telephone wire through the air had to buy a right of way. When airplanes were invented, this law became a millstone about societys neck. Under this law a transcontinental airline would have to buy a right of way through the air of every property owner in its path from New York to San Francisco. The modification of this rule by judicial decree is one example of the law changing when circumstances change. Common law is the source of much of our business law today.
