Here's the report from the Toronto Star: The man featured in a startlingly clear surveillance video shooting a gun aboard a TTC bus last year broke down Thursday at his sentencing hearing as he apologized to the community.
Im not a gangster. I dont walk around with a gun, said Richard Haynes, 29, his voice choked with emotion. I tried to take it off the bus. I apologize for that ... Id never hurt anybody.
On Monday, Haynes pleaded guilty to attempt murder before the start of his preliminary hearing.
Ontario Court Justice Carol Brewer agreed to a joint submission from defence and the Crown that Haynes be sentenced to nine years in prison for the Feb. 23, 2009 shooting aboard a TTC bus filled with people on Oakwood Avenue.
His intended target was struck in the hip and has recovered. A ricochet of the shot penetrated the outer layer of the coat of a female passenger and lodged in the lining of her coat.
The mid-afternoon incident was caught on four security cameras mounted inside the bus.
Defence lawyer Sean Robichaud told the court that Haynes, who had no criminal record, has learned deeply from his mistake.
He added the Blu-ray quality of the video shows the power of TTC cameras and that individuals who engage in unlawful behaviour will be found by the police.
Marlon Cooper, 22, a friend of Haynes who pushed the victim on the bus but wasnt armed, pleaded guilty to assault causing bodily harm, was released from custody.
Cooper was given credit for time served and put on probation for a year.
Court heard the two were on the bus looking to retaliate after a then 17-year-old stabbed Haynes in his mid-section earlier that day. Haynes said he wanted the teen to apologize.
