"The ruling of the Court of Appeals on the inclusion of the Retirement Plan as a valid issue in the collective bargaining negotiations between UFE-DFA-KMU and Nestle is AFFIRMED. The parties are directed to resume negotiations respecting the Retirement Plan and to take action consistent with the discussions hereinabove set forth. (the Supreme Court of the Republic of the Philippines 1st Division G.R.Nos.158930-31/ G.R.Nos.158944-45 UFE-DFA-KMU VS. Nestle Phils., Inc. August 22, 2006)

And that the same has, on March 26, 2008 become FINAL and EXECUTORY and is hereby recorded in the Book of Entries of Judgments.

Just because you took the risk, it does not mean you have the right to exploit other people! Wage labor, or shall i say wage slavery, is a form of economic exploitation, creating "profit" from the workers labour. Ask yourself this, how much do a worker get paid an hour and how much value do he/she create in that hour? Its a simple issue, you are either for or against exploitation.....

To further clarify my building-janitor example, we can't all be janitors someone has to run a building. We can't all be farmers because someone has to bring the food to the consumers. We can't all be traders because someone has to grow the food. Similarly we can't all be doctors, teachers, journalists, etc. no matter how noble the profession is and despite the utopian visions of Marx. The question is who or what decides when one profession is adequately filled and another needs more? A violent mob or the consumers in the free market?
These a-hole KMU people just want the power to decide who gets what job and for what salary. AS IF NO CORRUPT GREEDY SELFISH POLITICIAN WANTS THE SAME.

Well, SOMEONE HAD TO RISK MONEY BUILDING A FACTORY THAT MAY NOT HAVE MADE MONEY. SOMEONE HAD TO RISK MONEY INVESTING IN THE PHILIPPINES THAT COULD'VE LOST MONEY. SOMEONE HAD TO INVEST IN THE LAND, BUILDINGS, EQUIPMENT ETC. SO THAT YOUR OTHERWISE MINDLESS LABOR OF SWEEPING FLOORS, DEPRESSING A LEVER, MIXING, ETC. COULD BE DIRECTED INTO CREATING A PRODUCT A CONSUMER WOULD WILLINGLY BUY.
That's why your union strikes are stupid. That's why your union leaders should hang for this death! They sacrificed this person's life just so they can get a cut off the collective bargaining agreement. YOU HUMAN RIGHTS VIOLATORS OUGHT TO BE HANGED!
I have to hand it to Marx though, he wrote Das Kapital and it can render most people impervious to common sense.

Oh I know all profit is expropriation from labor like what MArx said. Well, answer me this: do you think if you walked into a random building and just started cleaning the floor without anyone asking you to (while doing a very good job!) you'll automatically get paid? No! Why? Becuase someone had to RISK money to build a building first. For that to happen, someone had to RISK money making business that would rent that building. For that to happen, someone had to RISK money on an idea or product that consumers would willingly buy. Each risk has many incalculable variables, many not even the entrepreneur is fully aware of. And you dismiss it as mere expropriation.

You always focus on YOUR rights. What about the rights of others (ie other workers and Nestle)? Don't other people have the right to work for Nestle at the wage you dont like? But NOOO you just want to monopolize the supply of labor for yourself. Oil monopolies are bad but not labor monopolies what stupid double standards. And doesn't Nestle have the right to do what it wants with the money it earned? Did it force consumers to buy its products? NO! Consumers bought them willingly because it made them better off.
