Actually, freedom of speech isn't guaranteed by the first amendment. It wasn't until the '20s in NY vs. Gitlow that the 1st amendment was made to apply to the states. Before that it only applied to the federal government & was understood to mean that the state could not license literature. It was still allowed to punish speech it did not like. People were sent to jail because they opposed WWI. It was only in the '60s that the courts interpreted the law to apply to the high levels of free speech

C'est vrai qu'il est stupide d'interdire la recherche historique sur certains sujets (cf loi Gayssot). D'ailleurs, c'est notamment grâce à tout ce scandale que Faurisson a pu avoir autant de succès : D'abord, il a été médiatisé, mais surtout, il a été considéré comme une victime.
Néanmoins, ses thèses ont été réfutées par des historiens plus sérieux, notamment après la chute de l'URSS et l'accès aux archives du KGB, qui détenaient celles d'Auschwitz.

Actually, freedom of speech isn't guaranteed by the first amendment. It wasn't until the '20s in NY vs. Gitlow that the 1st amendment was made to apply to the states. Before that it only applied to the federal government & was understood to mean that the state could not license literature. It was still allowed to punish speech it did not like. People were sent to jail because they opposed WWI. It was only in the '60s that the courts interpreted the law to apply to the high levels of free speech

If you read French, I strongly suggest the book by Pierre Vidal-Naquet, "Les assassins de la memoire" (The assassins of memory). There is a whole chapter about Chomsky and the Faurisson Affair.
I believe that Chomsky has made a big mistake in defending Faurisson's "civil right" of saying that no extermination ever took place. Also, I am sure that Chomsky knows it's a mistake, but doesn't have the guts to aknowledge it.
It reminds me when Chomsky took the defense of brutal Pol Pot.

Faurisson was condamned for "contestation de crime contre l'humanité", i.e. because he denies holocaust. You have to distingue the two charges, wich are not the same. There is a specific article for Holocaust denial in our Code.
When Le Pen says that the negationism has the same value than history, he makes a negationist statement. Negationism is not history, negationism is just a lie.

The Pen's statement I mentioned did not itself suggest negation, and according to wikipedia, he was convicted for THIS statement.

You're wrong. While it's true that MOST 'revisionism' is motivated by racial hatred or racism, this is NOT always the case. Chomsky said: "even denial of the Holocaust would not prove that a person is an anti-Semite.... Prove it! It may be the case that most deniers are neo-nazis (this is also thanks to the law), but you have no evidence that ALL deniers are neo-nazis or have anything to do with nazism. Holocaust denial does NOT prove that a person is an anti-semite/racist/nazi. Freedom of speech? Unlike for Chomsky, freedom of speech has nothing to do with my position, and I have no wish to defend it, unless it limits what I have to say. I object to the criminalization on basis of it outrightly distorts logic. On the contrary to your and France's rotten logic, there is no evidence whatsoever, that every holocaust denier incites or tries to incite racial hatred, hatred towards Jews or action against Israel. None of these are proved in any way by holocaust denial itself.

I agree with Chmsky on freedom of speach BUT I think what throws this video in the TRASH CAN is that there is too much editing. You cannot see a whole discussion they are just random clips and ir seems to me the editor selected the clips to create a logical realm for Faurison which I didnt think it did.
