If you count it straight and-3, and-1. 1, 2 AND 3, 4 AND 1. The "and 3" and "and 1" make it easy to count for me because that's where I'm hearing consistent accents.
I'm counting 4/4 as well. 12/8 is compound rhythm. I'm not hearing the bassist play a compound rhythm. To me, it sounds like Elvin Jones is playing a lot of syncopated rhythms on the snare and accenting a lot of the upbeats, maybe that's why it sounds like it's not in common time. Either way, it's badass.
@jodi183 yes just focus on the hi hat that tells you it is in 4/4. Elvin Jones never seems to do the obvious a truely gifted drummer. Have a listen to "all or nothing at all", the drum intro is amazing..
@excitingmusic1 Jazz is triplet based, which is basically what swing is. I wouldn't say this is in 12 at all. Elvin is playing almost all swung 8th notes.
