And clarification of any type is policy making, clearly, because you are giving specificity to something that was previously vague. I fail to see why anyone has a problem with that concept. The question is how will she do that not if she will.

You may want that to be the case but it isn't and you should understand the role of the judiciary in the United States or attempt to change its role if you don't like it. The whole reason we have _case law_ is because cases of higher courts make law.  The legislature can then change the law if they dislike the ruling of the courts. Take the Lily Ledbetter case. SCOTUS said she couldn't sue according to how they read the law so Congress changed it. That is our process.
