It just occurred to me: If it's Castle -- the writer, not one of the 3 armed cops -- who announces, "You're under arrest," then if they were actually guilty of something (aside from their previous convictions), would that get them off on a technicality? Or would the cops then have had to read them their rights as if they were actually being arrested?

@UncleMikeNJ You don't get read your rights when you're first arrested, only when they want to interrogate you. The Miranda Rights are to protect you from the inherent unfairness of police questioning, BUT, if you're just talking and they haven't actually asked you anything, they're in the clear.

The Miranda Rights are there to protect you, yes, but they are required to advised you of your rights before questioning and when first arrested with witnessess. Things may have changed from when I was a cop in the 1990s but cops want to ensure that suspects are marandized as soon as possible as to avoid possible ramifications during courtroom proceedings.
