within the first thirty seconds of the interaction the police noticed that we were there asked us who we were and then ignored us with the exception of telling the people who they had stopped to tell us to "go the fuck away." Also in the second minute of this video the officer we were talking to told us that we were "welcome to stay and record" while they finished filling out their cards. This is not even implied consent it is consent.
I know you weren't recording sound on the public way without the consent of all parties involved, because that would be eavesdropping in the state of Illinois. The fact that you recorded Police Officers would upgrade it to Aggravated Eavesdropping, which is a Felony. Thanks for the video. It has been saved. You really aren't as smart as you think you are.
Our right to observe and record police activity in a public area has been upheld in court numerous times. Also Illinois law states that eavesdropping is done with an "eavesdropping device" and the law specifically states that a camcorder is not an eavesdropping device. Also the officers saw the camcorder as soon as we arrived on the scene: after we identified ourselves they said "alright" this is consent. If they had had a problem they should have asked us to leave and not used their suspects
