What I do know is that India will never realise its full potential unless and until it stops its human rights abuses in J&K and allows the people to choose their future, just like Palestine and the soon to be held elections in Southerm Sudan.   • @rajeev10able It is Article 370 and not 356. Article 356 deals with President's Rule in a State. Article 370 was the condition that Maharaja Hari Singh, the King of Kashmir, negotiated with the Government of India for full autonomy of the State except in Defence and Foreign Policy issues. Basically Maharaja Hari Singh wanted to retain his control over his Kingdom after accession to India. The set of laws applicable in Kashmir is called the 'Ranbir Code' named after one of the King's ancestors.

Over 100k Kashmiri Muslims have been killed in the last 25 years. Independence will come.

  • @rajeev10able Article 370 cannot be revoked unilaterally by India because Kashmir dispute is in the United Nations since 1948. If India does this then there will be UN military action and UN military forces led by US, UK, China and Russia will occupy J&K.

  • @Achintyanath - I did NOT say Hindus should support anyone. It is inevitable that J&K will be divided along religious lines as did India and Pakistan in 1947. I suggest you seriously look at the "Chenab forumula" and other practical measures that would see Muslim majority areas become independent or merge with Pakistan, while areas with Hindu majority would merge with India, of course this would depend on a plebiscite where all votes are counted.

The partition of India also happened because the Allies i.e. US & the UK, wanted it. Also, I don't understand why there is a need for a separate homeland for Muslims.   • @Achintyanath - I doubt Kashmiri Muslims would have entertained the idea of separatism if India treated them as equal citizens and provided for their social and economic development in the state. India has consistently undermined human rights with a bloody onslaught civilians under any pretext possible. Extra judicial killings, rape and pillaging is not uncommon. In such a state of oppression and subjugation, you expect them to feel "Indian" do you?

  • @zakuk77 The state of J&K gets more than its fair share of funds from the Central Government. The problem was that due to corruption in the Abdullah regime those funds did not reach the common man. Also, from the 1980s onwards, the issue of corruption was turned into a communal issue between the Hindus and Muslims of the Kashmir valley by certain Islamic groups which were believed to be encouraged by the Gen. Zia regime in Pakistan as part of 'Operation TOPAC'

Zia to expand Pakistan's power in the Indian subcontinent by destablising India and encouraging and training Indian insurgents whether in Punjab, Kashmir, or the North-East India. It was also seen as Gen Zia's revenge for the division of Pakistan into Pakistan and Bangladesh in 1971 in which India was a key facilitator.

  • @zakuk77 As far as extra judicial killings etc are concerned, as an ordinary citizen in India which is one of the most corrupt countries in the world, everyone of us face the same ordeal everyday as the Kashmiris do. The Police in India is the same everywhere. The rest of us Indians do not demand independence for this, instead we take recourse to the media and the judiciary to deal with Police atrocities and victimization. This is no ground for demanding independence.

Indians, especially the Hindu population, is majority secular, socialist or even communist in ideology and for us religion is something either obsolete or best expressed in private within the confines of one's home. The recent butchering of over 150 Muslim civilians in and around Srinagar proves this point. When human rights are violated on such a grand scale as Indian occupational forces have perpetrated, no sane person would sit back and allow it to continue de facto.

And please keep in mind that it is the exceptions that go on to make the rules. When Islam began in the Middle East, it was the exception and now it is the rule.

  • @zakuk77 Also, this year's topper of the Indian Civil Services Examination, which is the most prestigious competitive exam in India, is Dr. Shah Faisal, a young doctor from Srinagar in Kashmir. He will be joining India's elitest and most powerful government service i.e. the Indian Administrative Service. Even the Kasmiri Muslim youth in my university are now preparing for Civil Services. Therfore I don't think that it would be right for you to say that all Kashmiri Muslims want independence.

Out of the 20 selected for the training from the whole organization this year, two scientists are young Kashmiri Muslims. When these Kashmiri Muslims can work in the very organization which develops and designs weapons for the Indian Army, how can you say that every Muslim in Kashmir is against India ?

  • @Achintyanath - using extreme and fringe examples do NOT represent the rest of the situation and reality on the ground. I know many nationalist/racist Indian Muslims who are easily bought into the Indian propaganda program with a very small price. I suggest you go down to the grass-roots and speak to the thousands of families who have suffered the death of a loved one under the brutal Indian occupation regime. There is no love lost between the oppressed and the oppressor!

  • @zakuk77 As I have iterated earlier, from where I stand, I see that the Indian Police and Administrative system is un-responsive and corrupt and even anti-poor in all parts of India. Therefore the perception of Indian oppression by Kashmiri Muslims is erroneous. The common man in India suffers daily from these administrative hassles but so far has not demanded independence from his own State.

  • @zakuk77 Even the Maoist insurgency in India which has spread very fast in the last decade and has replaced J&K as the biggest security problem for the Indian State aims to overthrow the current Indian State and establish a Secular Communist country in India on the lines of the USSR and China instead of demanding any independence from the Union of India.Poor people in the most backward areas of India support Maoists as they think that development and justice are more important than religion.

It is also not internal because J&K was never an inherent part of India, its autonomy was undermined when it was illegally "acceded" to India by a unilateralist Sikh maharaja.

  • @zakuk77 Hari Singh was a Dogra and not a Sikh. Also, the rulers of all the independent states were given the option to join India or Pakistan but Hari Singh took the third option i.e. to keep Kashmir independent. He changed his mind when the Pakistanis attacked Kashmir in 1948. He then entered into a treaty with India to accede with certain guarantees which have been incorporated into Article 370 of the Constitution of India

  • @Achintyanath - The treaty of accession is revocable because the "certain guarantees" that you speak of were eroded over the decades. As you rightly said, rulers of all the independent states were given an option; this option was to be made after consulting with its people, which Hari Singh did not do. p.s. most Dogras are Hindu, with a small minority of them being Muslim or Sikh.

  • @zakuk77 International treaties are not easily revocable plus the guarantees provided in Article 370 have not been eroded at all. Rather, the ruling elite in Kashmir, the Abdullahs and later the Muftis, misused and abused those guarantees to make money for themselves at the cost of the poor Kashmiris who were misled into believing that the chief and only cause of their misery was the Government of India.

  • @zakuk77 About the so-called occupation, I would like to point out that the State of J&K like the other states in India, has an elected government. If the people and the civil society in that state fail to elect honest and efficient leaders then how is New Delhi to blame ? J&K has its own constitution as well as its own laws and only Defence and Foreign Affairs are with the Central Government. They even print their own revenue stamps and stamp papers.

If this was followed then Lahore would have been in India because the Sikhs were in majority there followed by Hindus and then Muslims. Everything was decided in haste by political leaders and the common people were adversely affected by the leaders' dealings.

The problem of corruption and police brutality is a pan-Indian problem that is treated as a religious one only in the Kashmir Valley. This is so because in the early '90s, almost all the liberal and secular human rights activists and journalists were murdered by the militants systematically.

  • @Achintyanath - The sheer contrast in the treatment of Hindu maoist rebels and other Hindu separatists in parts of India to the Muslims in J&K is very sharp. Of course it is a religious problem because India has never come to terms with the separation of Pakistan in the first place! Being a Muslim majority state, large parts of J&K should have become part of Pakistan anyway, according to the rules of division. It was an illegal unilateral act whose consequences have cost over 150,000 lives!

For them the only reality of the world is class struggle between the haves and the have nots and that the only way to remove the misery of the have nots is the extermination of 'class enemies'
