5-4 vote. To close to comfort for sure. I don't have any fancy law degrees, but what is it about "Shall Not Be Infringed" that they don't comprehend? Even i can figure that one out.
5 to 4 ? how can we have 4 judges that would vote against the 2nd amendment . that ratio will not change when Kagan gets in . And if something happens to one of the 5 that voted properly,,,,, and it happens during this or any other progressive socialistic marxist communist unconstitutional minded administration , how do you think this will turn out then ?And now they are going to start on the 1st ?
Yes, but once Kagan is on-board the SCOTUS will bring it up for vote again, especially with a push from Sotomayor, and go the other way since Sotomayor is 'now' unable to locate where it says so in the Constitution
Today it was 5-4 but it will go 4-5 with Kagan ^_~

Every bill he signed , Every appointment he made, Every treaty he signed will become null & void.

I wouldn't hold my breath as whether Congress would uphold their swearing to the Constitution; that doesn't appear to be the case for some time now.
I do hope the Senate will lose the Dem majority but that's doubtful; the House though will or should have quite a few new seat-dusters
I too would like to see all of the ONE's records unsealed so they can be reviewed
