  • You are within lawful rights to record public servants in a public place, and under TX penal code 38.02 you are only required to present identification to a police officer if you are being detained, if they are investigating a crime or believe you may be a witness to a crime, but this is a sticky situation that could be bent a number of ways, depending on whether they could prove a crime had been committed and that they were investigating, in which filming them could make you a witness.

  • @r19600202 Cops do NOT need a reason to ask for an ID. Same reason why they do NOT need a reason to ask for consent to search your vehicle, person, house, or property. You are only REQUIRED to give up an ID, or identify yourself in certain situations(terry stop/arrest). No question, the cop was in the wrong here and the guy legally refused. That doesn't mean that cops cant ask for an ID though. Some just don't know what to do when you say "no"... they get flustered and think they can demand it.

  • Ok it seems a little dumb the way this was handled but he was asked for his ID or drivers license but he said he had neither then said he had a Driers license but would not give it to him so i got to give this one to the cop he was just doing his job, plus their was a shooting their not long before he got their so he was just doing his duty making sure this guy was who he was saying he said.

  • One problem, the DPS Trooper should have hooked him when he refused to show any form of identification. First the suspect stated he had no id and then changed his mind. He was asked for press credentials and had none. Hook him, and find out what is going on.  A shooting had just occurred at the Capital and no one is above suspicion at that point.

  • I don't want to start a flame but if you are being "leaglly detained" under reasonable suspicion that you have or about to committe a crime, you must id yourself not produce an ID. Hibel vs Sixth Judicical District. The key is knowing if officer is acting within the law. In the video it appears that no legal reason was present for dentetion and that is the reason the second trooper backed off.

    That's what you think. The statute you mention here, can easily be drawn out into 'failure to provide ID on request to a police officer'. There are laws that give more power to police, than to citizens, and don't think for one second they are not going to use those laws to rebut any statute you bring up. The Patriot Act, will take care of the rest.

And, many times, regardless of case-law, or civil liberties, you will get a settlement, which includes stipulations such as 'the department will admit to no wrong doing', if a civil case.   • You do not have to produce ID but you do need to "ID" yourself if asked. The requirment is met if you gave youre name. SSN and birthdate is not needed.

  • You do realize if you are innocent showing your ID actually speeds things up and they have no rights to detain you. When you don't show your ID and you admit you have one on you, they have the right to detain you on "suspicious action"...after a SHOOTING incident and you acting shady... If you don't have an ID, they can ask for your name. After a shooting incident it is easier to cooperate with the authority rather than make it harder for them, which will only lead to you being detained.
