I could bet money that "cop" is on drugs. The tics he has at 1:46 to 1:50 and the way he behaves acting real nervous and being out of breath for no reason at all is a dead giveaway.
This cop is way out of line. If there was no offence commited then he doesn't have to identify.....not to mention he is on public property. The only time he would have to identify would be if he were pulled over in a vehicle....then it would be a fail to identify.
"Doing my Job". Yeah, the Nazi's said the same thing after they killed millions of women and children. Fuck all of you law enforcement faggots who protect the man and his money. When the shit hits the fan, you think those suits give a fuck about you? Stupid ass cops, sherriffs, and troopers. None of you have a fucking clue!
@antonioruelas81 "shit now I gotta make me up sumtin, well oh shit, damn what would work oh yeah suspicious person, I dont even know if thats a real basis but hell I might as well try"
You are within lawful rights to record public servants in a public place, and under TX penal code 38.02 you are only required to present identification to a police officer if you are being detained, if they are investigating a crime or believe you may be a witness to a crime, but this is a sticky situation that could be bent a number of ways, depending on whether they could prove a crime had been committed and that they were investigating, in which filming them could make you a witness.
@fixyourshit: I thought 38.02 said that as well, until I looked at it closer.
Apparently I do not have to give ID unless I am arrested. "...who has lawfully arrested the person..."
However, if I do decide to ID myself before then, I had better be very exact, because it is a crime to give false info "...intentionally gives a false or fictitious name, residence address, or date of birth..."
Hum Whats the trooper have to hide.I wouldn't like it either some one standing around pointing a camera at me. I have had people come on my property and take photos. I get kind of aggravated when some one take photos of my home are me.
yea fuckin dumbass non Constitutional cop... thats why u was asked to just step lil farther back and u wasnt arrested for not showing cuz u dont have to unless uve done something wrong... more ppl need to know the rights n stop tryin to bust ppls balls that know that rights the the cop was doin! nicely down on holding ur ground sir:!
Oh come on.........I don't really like cops but you are egging him on and effing with him. I would love to brutalize you myself just for making a mountain out of a moe hill. Show him the freaking ID and move on.
@r19600202 Cops do NOT need a reason to ask for an ID. Same reason why they do NOT need a reason to ask for consent to search your vehicle, person, house, or property. You are only REQUIRED to give up an ID, or identify yourself in certain situations(terry stop/arrest). No question, the cop was in the wrong here and the guy legally refused. That doesn't mean that cops cant ask for an ID though. Some just don't know what to do when you say "no"... they get flustered and think they can demand it.
Ok it seems a little dumb the way this was handled but he was asked for his ID or drivers license but he said he had neither then said he had a Driers license but would not give it to him so i got to give this one to the cop he was just doing his job, plus their was a shooting their not long before he got their so he was just doing his duty making sure this guy was who he was saying he said.
One problem, the DPS Trooper should have hooked him when he refused to show any form of identification. First the suspect stated he had no id and then changed his mind. He was asked for press credentials and had none. Hook him, and find out what is going on. A shooting had just occurred at the Capital and no one is above suspicion at that point.
If we demand police to know all the laws then we should be respondsible enough to be aware of the laws as well, especially one so important as to when it is legal to give information to police and when and how to obey their orders. Yes, they can give orders, we the people have given those powers. If you want to restrict them there is only one way that works, get out the vote.
I don't want to start a flame but if you are being "leaglly detained" under reasonable suspicion that you have or about to committe a crime, you must id yourself not produce an ID. Hibel vs Sixth Judicical District. The key is knowing if officer is acting within the law. You missed the point, obviously. You are naive to even believe those words anymore!
The point is, they don't give a shit. And, many times, regardless of case-law, or civil liberties, you will get a settlement, which includes stipulations such as 'the department will admit to no wrong doing', if a civil case. Winging it huh? Tell that to the guy who refused police entry into his house, and was shot and killed point black for it! Worth it? Please don't say yes, ill vomit!
": Jason Alan Kemp, 31, was shot at point-blank range and killed when he refused to allow officers to enter without a search warrant. As for your Patriot Act comment. Because again you missed it, that comment I made about the Patriot Act, was being sarcastic to your 'I'm a civil libertarian' mentality. What I meant, as it seems to require your clarification, was the Patriot Act, will take care of other 'civil laws/liberties' and justify them on a federal level. As you can't be that stupid to think, State, has power over Fed! Go head, wing it!
@JHJones1333 That is correct. Also, they can detain you without cause for up to 24 hours. I like how the officer tries the bully tactics and when that doesn't work he is totally at a loss. Nice hat though.
@yandykun: As disgusting as that piece of filth called the "Patriot Act" is, I have never seen a thing in it that affects state police stopping or questioning a person.
You do not have to produce ID but you do need to "ID" yourself if asked. The requirment is met if you gave youre name. SSN and birthdate is not needed.
To not practice your rights is as anti-American as I can imagine, but go ahead and shy to the face of authority. At least you won't pose a threat to the smallest of adversaries you pansy.
Seriously, I would have a hard time being the boss of these cops. If a subordinate came up to me stating a citizen was filming him, I would tell my trooper to quit being a damn baby and go find something more constructive to do, like actual police work.
If you actually had a brain, you could research all this yourself. Obviously we are not killing millions of jews, but the we are turning into a police state, just like Germany and other dictatorship like countries. Quit drinking the koolaid and open your eyes.
@zuketheduke100 Yeah just let them detain you indefinately, Just let them search you, just let them do anything they want to because its EASIER. If you live in America you really need to pack your shit and leave because you are a disgrace. Anyone who is willing to give up a little freedom for protection(which is easier) deserves neither.
@dibdevlon Relax man. They are just doing their job. I realize you don't HAVE to give them your ID. I know that. And I didn't say "let them do anything." But holy shit man. Do you really feel violated if a police officer asks a simple request? I understand your argument, but as a law abiding citizen, I don't really give a shit if a cop asks me to do something as benign as that. So let's all get a fucking grip.
You do realize if you are innocent showing your ID actually speeds things up and they have no rights to detain you. When you don't show your ID and you admit you have one on you, they have the right to detain you on "suspicious action"...after a SHOOTING incident and you acting shady... If you don't have an ID, they can ask for your name. After a shooting incident it is easier to cooperate with the authority rather than make it harder for them, which will only lead to you being detained.
@mohab18 Then you can file a police report. Get that officer fired or put a desk job. It's your right to. If you want to do that, you can. If you LET officers do this once, they'll do it again.
@mohab18 this man was simply expressing his rights. unless you are under arrest for criminal activity or behind the wheel of a vehicle you do not legally have to provide ID to anyone.
@dreindabridge WTF is up with the race bullshit. Ya the cop was wrong to demand an ID when the guy did nothing wrong. That's not racism dummy that's a cop over reaching and trying to dominate innocent civilians. He's still an ass hole for doing this, but DROP THE FUCKING RACISM.
and i'm a white dude. black dudes, brown dudes, yellow dudes are all cool. The individuals are either cool or pricks, NOT the fucking race.
You racist fuckers are the problem with this world.

Well as much as i have them respect to the cops for not going way overboard. I this had happened in oklahoma they would have beat your ass took your camera and destroyed it claiming there never was a camera and thrown your ass in jail on a slew of made up charges.
So, that cop thinks he can detain and demand I.D. from anybody he wants... because of 9/11? Holy shit. He knows how stupid he sounded, as soon as he said it. That's why he left.
Love the cop at the end. The dumbass black cop explained what happened, and the cop at the end was probably thinking, "Ugh... Moron. You can't just detain people, because you don't like them."

To not practice your rights is as anti-American as I can imagine, but go ahead and shy to the face of authority. At least you won't pose a threat to the smallest of adversaries you pansy.
JayHugh1982 1 week ago
Seriously, I would have a hard time being the boss of these cops. If a subordinate came up to me stating a citizen was filming him, I would tell my trooper to quit being a damn baby and go find something more constructive to do, like actual police work.

Just show him your ID. If you're not guilty of anything, just comply with him. It makes things a lot easier.
zuketheduke100 1 week ago
@zuketheduke100
The point is that you do not have to show ID if you are not doing anything illegal.
MudHut67 1 week ago
@zuketheduke100
Yeah, that's what the Germans said during the Third Reich.
normanmj 1 week ago
@normanmj Of course. When all else fails, resort to Hitler and the Nazis. Because that's exactly like what's going on here.
zuketheduke100 1 week ago
@zuketheduke100
If you actually had a brain, you could research all this yourself. Obviously we are not killing millions of jews, but the we are turning into a police state, just like Germany and other dictatorship like countries. Quit drinking the koolaid and open your eyes.
normanmj 1 week ago
@zuketheduke100 Yeah just let them detain you indefinately, Just let them search you, just let them do anything they want to because its EASIER. If you live in America you really need to pack your shit and leave because you are a disgrace. Anyone who is willing to give up a little freedom for protection(which is easier) deserves neither.
dibdevlon 1 week ago
@dibdevlon Relax man. They are just doing their job. I realize you don't HAVE to give them your ID. I know that. And I didn't say "let them do anything." But holy shit man. Do you really feel violated if a police officer asks a simple request? I understand your argument, but as a law abiding citizen, I don't really give a shit if a cop asks me to do something as benign as that. So let's all get a fucking grip.
zuketheduke100 1 week ago
@zuketheduke100 said: "Do you really feel violated if a police officer asks a simple request?"
I do feel violated if I am stopped and questioned by officer that do not have suspicion that I'm acting unlawfully.

razed1022 1 week ago
You do realize if you are innocent showing your ID actually speeds things up and they have no rights to detain you. When you don't show your ID and you admit you have one on you, they have the right to detain you on "suspicious action"...after a SHOOTING incident and you acting shady... If you don't have an ID, they can ask for your name. After a shooting incident it is easier to cooperate with the authority rather than make it harder for them, which will only lead to you being detained.

@mohab18 said: "When you don't show your ID and you admit you have one on you, they have the right to detain you on "suspicious action""
Please cite this law you say exists.
Thanks.
Pafoofnik1 1 week ago
@mohab18 Then you can file a police report. Get that officer fired or put a desk job. It's your right to. If you want to do that, you can. If you LET officers do this once, they'll do it again.
dkfa 1 week ago
