Sorry that happened to you Skorpion but you may have to move back home, temporarliy. Next time, do research on apartments and ask friends about their experience with their landlords. The only thing I can say is take them to court and get some of your money. They knew about their situation and they didn't tell you about it.
I would give it another week, but if that does not work, then take them to court for your rent and security deposit so you can find you another place, but yes you may have to move back home temporarily until you find yourself another place. But be careful because if you stop paying your rent you may lose in court, so you can still sue them for everything from the beginning of your problems and still come out on top.

You have a case that your landlord isn't providing the standard required by law. Most states have implied warranty of habitability laws. If you dont have any heat then I bet your landlord is in violation of this.
I would look into my state laws if I were you. And then mail all the evidence to your landlord with a request to be let out of your lease.
Skorpion sweetheart you are toooo patient. YOu got 2 options in my opinion. Go home and then get an attorney to get some or all of your money back. Or give the landlord a 7 day notice to make good and then move home if this isn't settled.
I had similar problem in my building in Brooklyn, New York. I am disabled, and use a scooter to do my day to day. After repeated elevator outages left me high and dry, I reached out to my local Council Woman, who advocated on my behalf. I also contacted the local media to shed light on my situation. (I even included a couple of pictures of me looking especially pitiful pressing the button of an elevator that would never. In a wheelchair of no less) I hope this helps
Honestly, if I was in your situation you can either:
1. either move out your apartment to another one
2. move back in with your mother
3. Organize a community meeting for your apartment, have everybody together and talk to the landlord or/and the place downtown. Unity in numbers can make ppl get the job done. If they do not cooperate fast enough, the whole building or floor shall not pay rent, tell the landlord that. Strength in numbers KEvin.
Hey skorp, If I were you I'd see if they(slumlord,lol) possibly has an apartment available on the top or bottom floor that you could move into since THEY seem to have everything together and when your lease is up...boune. I have a coworker who after problem after problem was able to move into another apartment in the same complex.

Wow! I hate you have to go through all this! I'd be looking for another place ASAP. Whenever you're apt hunting, always try to speak to a current resident of the place you're considering and get a history of any problems they've had w/the landlords/utilities/etc.
And like a lot of ppl have said already, you need to be documenting all this stuff (with dates and times of everything) also, always get the name of the person with whom you're speaking at each company you deal with.
I am a collector for a energy company in NYC. You shouldnt have paid the bill in the first place because the bill was not in your name. Unfortunatly, you would have to get your money from your landlord. You could get the portion from the rent you would have paid him, or you could take him to small claims court.
I'd continue to not pay rent until he fixes the problem. I would also review the tenant/landlord rights in your city. Document all your attempts to resolve the issue. If all else fails, report his ass the appropriate housing authority in your city.
As a person who works in leasing....I just stress put things in WRITING!!!! if you have concrete documentation that you did everything on your part then there should be no way you can lose a case if you sue!!! Scorp this is a legal recommendation sue the landlord in small claims court, also report him to the better business bureau also report him to the Attorney Generals Bureau of consumer reports you can go on the website in fill out the application or just fax , Also if possible get a letter from the other tenants in your building to build a report on your landlord also for edvidence against him also when you go back down to the building ask the for documentation stating the illegal activity .

Although I live in NY most of the housing laws are basically the same. There is NO WAY your landlord can continue charging you rent and your apt. in basically inhabitable due to NO Electricity!! I was in a similar situation and I had to back home too. Hang in there and pray for guidance. Also, write letters to housing authotity to see if there is anything that can be done to help you i.e. arbitration/ negotiation with the electric company or if you hire an outside inspector can you be reimbursed by the landlord or the electric company. Tell the power company that you have small children in there and they will rush in fear of a big lawsuit. If the landlord is acting up you should call the local news.
If your apartment is unlivable(which it is b/c you have no power due to the landlord not being a responsible person) then you have a legal right to break the lease and move. You have already been inconvienced for 3-4 weeks. That is unacceptable.

Philadelphia Tenant Action Group (TAG) - 215.575.0700, Fair Housing Commission - 215.686.3237 and Pennsylvania Office of Consumer Advocate - 800.684.6560. Unfortunately, if you signed a lease you have to continue to pay rent .. no paying your rent can lead to an eviction and you dont want that in your rental history. Hope it works out ..
Is it a verbal mo to mo agreement? If so today is the 30th, so move ASAP. But still document EVERYTHING, you may be able to get assistance from an advocacy group to get your money back from previous months rent you paid .. the apt was inhabitable due to the landlords negligence in bringing the electricity up to code, but you HAVE to have documentation from PECO to support your claim .. call the advocacy groups if you have a chance and find out how to submit a claim against the landlord

Was all utilities included in the contract? If so then you can get your money and move out...... if not then there is not much you can do. Call a real estate lawyer. They can tell you exactly what to do.
Send them a formal letter with all of the details on, including how they have mucked you around and a copy of the contract with the parts all inclusive highlighted. Then give them an ultimatum and tell them that if it is not sorted by (whenever) you will be taking legal action and that you are currently seeking legal advice.
If you knew that you'd have to pay for the electricity, would you have signed a lease? Is the rent still cheap enough that you can afford to pay electricity. One of the reasons folks do "rent included' is b/c it can be cheaper than paying utility bills separately.
I'm trying to understand why some floors have electricity but not yours. If an underwriter has to show up, wouldn't it be for the whole building? Can they move you to another floor?
Please do not pay these people rent. I am a landlord for 10 rental houses and I know that my main responsibility is to provide my tenants with heat and electricity. You should not pay and let them try to evict you, then the judge would force them to do the upgrades to the building. Your landlord is not allowed to lease you a property that is all utilities included then change it after your lease starts. No you should not have to pay rent. Your landlord is responsible for your lights,especially since the lights are included. Mayebe you and other tenants need to get together and complain to the light company,landlord and hud(or someone who fights for the tenants rights. Kevin, b4 you stop paying rent, explain to your landlord IN WRITING, that they are not fulfilling their portion of the contract (that the bldg must be habitable & up to code). Also, if your rental contract states that you don't have to pay for electricity, then they need to compensate you by deducting off your rent. Just like the contract is binding for you, it also binds them.

Given this unacceptable circumstance, honestly take them to court. You have a valid argument with your contract as liable evidence stating the issue. Do NOT pay another dime to them at all. Remaining in good health is best. Go home, at least its free.
The landlord is the one that with holding your lights. Your floor is the only floor with out lights that's not normal if there was a problem with the building and it was not up to code the electric company would turn the hold building off. You paid the electric company and their money & they don't care.
You should have to put the lights in your name if it's included in the rent. The light company just wanted you to pay them, now their paid & their not coming out because there really isn't a problem. They just wanted you to pay them.
You do not have to pay rent for a place that is uninhabital. The apartment must comply with all building, housing, and health codes. You need to report him ASAP!

you kevin at the cout for your city there should be an office called The Landlord and Tenant dep. they oversee all disputes and in force city laws for free concerning landlords. you can even call them you dont have to walk down there and get there advice for what you legally can do at this point. every city has it. i have used them they were a big help. also scene your landlord has not honored his 1/2 of the contract you are free to move when ever you like. and sue him for all your expenses

You need to ask your landlord some serious questions! If they said electricity was included why do you have to now put it in your name? You said the electricity was in the building illegally aswell, you need to ask your landlord straightup whats going on and tell him you're not payinf rent because he/she should have been taking care of this! You need to find out the basic renting laws of Philly--but in most cases if you signed a lease and it said that all was included-- your rent would cover the electric.. So when you were told by your landlord that you had to put it in your name he/she knew there was a pre-existing problem--so look into landlord tentant court b/c they should be able to advise you better.
you might get some money since he leased the apartment when he knew it wasnt up to code. find a free legal clinic (are ran out of some churches) and get some advice.
I think that you should start looking for another place. and when you do make sure they've gone through the proper regulations. this landlord should be taken to civil court. it sounds tricky, if you still have your belongings in the apartment and use it technically you still must pay him rent. perhaps you could sue him for the rent you lost and all your trouble.
get a lawyer and keep documentation for everytime youve had to go to the electric company and if you can get documentation for what the electric company has told you about the building that would work in your favor as far as getting out of the lease and getting your deposit back. And if you have a copy of the lease stating electricity was included that will also help

The landlord has no regard for any of the tenants there. They knew this was going to happen.
You might have to just cut your losses and go. There will be alot of agro and hassle to try and chase your money up. Go to small claims court

I had similar problem in my building in Brooklyn, New York. I am disabled, and use a scooter to do my day to day. After repeated elevator outages left me high and dry, I reached out to my local Council Woman, who advocated on my behalf. I also contacted the local media to shed light on my situation. (I even included a couple of pictures of me looking especially pitiful pressing the button of an elevator that would never. In a wheelchair of no less) I hope this helps

Honestly, if I was in your situation you can either:
1. either move out your apartment to another one
2. move back in with your mother
3. Organize a community meeting for your apartment, have everybody together and talk to the landlord or/and the place downtown. Unity in numbers can make ppl get the job done. If they do not cooperate fast enough, the whole building or floor shall not pay rent, tell the landlord that. Strength in numbers KEvin.

Hey skorp, If I were you I'd see if they(slumlord,lol) possibly has an apartment available on the top or bottom floor that you could move into since THEY seem to have everything together and when your lease is up...boune. I have a coworker who after problem after problem was able to move into another apartment in the same complex.

Hey skorpion...I had a similar problem so instead of giving my landlord the money for rent I took it down to the courthouse and they held it bc I was not about to give them any money when they wasn't doing they job, and when they got everthing taken care of then they had to take proof showing that they fixed everything.If I was you I would be bad as hell...keep your head up!

Wow! I hate you have to go through all this! I'd be looking for another place ASAP. Whenever you're apt hunting, always try to speak to a current resident of the place you're considering and get a history of any problems they've had w/the landlords/utilities/etc.
And like a lot of ppl have said already, you need to be documenting all this stuff (with dates and times of everything) also, always get the name of the person with whom you're speaking at each company you deal with.

I am a collector for a energy company in NYC. You shouldnt have paid the bill in the first place because the bill was not in your name. Unfortunatly, you would have to get your money from your landlord. You could get the portion from the rent you would have paid him, or you could take him to small claims court.

I'd continue to not pay rent until he fixes the problem. I would also review the tenant/landlord rights in your city. Document all your attempts to resolve the issue. If all else fails, report his ass the appropriate housing authority in your city.

As a person who works in leasing....I just stress put things in WRITING!!!! if you have concrete documentation that you did everything on your part then there should be no way you can lose a case if you sue!!! Scorp this is a legal recommendation sue the landlord in small claims court, also report him to the better business bureau also report him to the Attorney Generals Bureau of consumer reports you can go on the website in fill out the application or just fax , Also if possible get a letter from the other tenants in your building to build a report on your landlord also for edvidence against him also when you go back down to the building ask the for documentation stating the illegal activity .

Although I live in NY most of the housing laws are basically the same. There is NO WAY your landlord can continue charging you rent and your apt. in basically inhabitable due to NO Electricity!! Plus why are YOU going to the city to find out why the house is not being inspected? You are just a tenant, he's the owner, HE should be going back and forth to find out. You should be holding your rent in the bank until you apt. is back to normal. Let him sue you! Don't spend the rent just hold it.

I was in a similar situation and I had to back home too. Hang in there and pray for guidance. Also, write letters to housing authotity to see if there is anything that can be done to help you i.e. arbitration/ negotiation with the electric company or if you hire an outside inspector can you be reimbursed by the landlord or the electric company. I think you should definitely seek legal counsel as it relates to breaking the lease, as well as, how you can get your money returned...the landlord is truly a slumlord, and based on his record with the city, has been such for a long time...which means he isnt going to change.you may not wanna go back to mom's crib, but hey,at least you'll have your money back, along with your peace, heat and electricity! Philadelphia Tenant Action Group (TAG) - 215.575.0700, Fair Housing Commission - 215.686.3237 and Pennsylvania Office of Consumer Advocate - 800.684.6560. Unfortunately, if you signed a lease you have to continue to pay rent .. no paying your rent can lead to an eviction and you dont want that in your rental history. Hope it works out ..

But still document EVERYTHING, you may be able to get assistance from an advocacy group to get your money back from previous months rent you paid .. the apt was inhabitable due to the landlords negligence in bringing the electricity up to code, but you HAVE to have documentation from PECO to support your claim .. call the advocacy groups if you have a chance and find out how to submit a claim against the landlord

Send them a formal letter with all of the details on, including how they have mucked you around and a copy of the contract with the parts all inclusive highlighted. If you knew that you'd have to pay for the electricity, would you have signed a lease? Is the rent still cheap enough that you can afford to pay electricity. One of the reasons folks do "rent included' is b/c it can be cheaper than paying utility bills separately.
I'm trying to understand why some floors have electricity but not yours. If an underwriter has to show up, wouldn't it be for the whole building? Can they move you to another floor?
BTW, w/ landlord, do all biz in writing!

Please do not pay these people rent. I am a landlord for 10 rental houses and I know that my main responsibility is to provide my tenants with heat and electricity. You should not pay and let them try to evict you, then the judge would force them to do the upgrades to the building. Your landlord is not allowed to lease you a property that is all utilities included then change it after your lease starts. Please call your local housing authority and they will let you know what steps to take.

No you should not have to pay rent. Your landlord is responsible for your lights,especially since the lights are included. Mayebe you and other tenants need to get together and complain to the light company,landlord and hud(or someone who fights for the tenants rights. (some places provide free legal services for situations such as these.) in any case it may be that the light company wont turn on your lights because the building is not up to city code. And if that is the case i would bet that

Kevin, b4 you stop paying rent, explain to your landlord IN WRITING, that they are not fulfilling their portion of the contract (that the bldg must be habitable & up to code). Also, if your rental contract states that you don't have to pay for electricity, then they need to compensate you by deducting off your rent. Just like the contract is binding for you, it also binds them.

Kevin, when renting an apartment, as I've seen with all the other previous comments before me that I concur with, there should have been a lease, a binding agreement on documentation stating that everything was included once reviewing the contract. Given this unacceptable circumstance, honestly take them to court. You have a valid argument with your contract as liable evidence stating the issue. Do NOT pay another dime to them at all. Remaining in good health is best. Go home, at least its free.

The landlord is the one that with holding your lights. Your floor is the only floor with out lights that's not normal if there was a problem with the building and it was not up to code the electric company would turn the hold building off. You paid the electric company and their money & they don't care.

You do not have to pay rent for a place that is uninhabital. The apartment must comply with all building, housing, and health codes. You need to report him ASAP!

you kevin at the cout for your city there should be an office called The Landlord and Tenant dep. they oversee all disputes and in force city laws for free concerning landlords. you can even call them you dont have to walk down there and get there advice for what you legally can do at this point. every city has it. i have used them they were a big help. also scene your landlord has not honored his 1/2 of the contract you are free to move when ever you like. and sue him for all your expenses

You need to ask your landlord some serious questions! If they said electricity was included why do you have to now put it in your name? You said the electricity was in the building illegally aswell, you need to ask your landlord straightup whats going on and tell him you're not payinf rent because he/she should have been taking care of this! If your landlord gives you the run around you need to look to the law and perhaps take him to court U desrve answers, dont be taken for a fool anymore

You need to find out the basic renting laws of Philly--but in most cases if you signed a lease and it said that all was included-- your rent would cover the electric.. So when you were told by your landlord that you had to put it in your name he/she knew there was a pre-existing problem--so look into landlord tentant court b/c they should be able to advise you better.

you might get some money since he leased the apartment when he knew it wasnt up to code. find a free legal clinic (are ran out of some churches) and get some advice.

I think that you should start looking for another place. and when you do make sure they've gone through the proper regulations. this landlord should be taken to civil court. it sounds tricky, if you still have your belongings in the apartment and use it technically you still must pay him rent. perhaps you could sue him for the rent you lost and all your trouble.

get a lawyer and keep documentation for everytime youve had to go to the electric company and if you can get documentation for what the electric company has told you about the building that would work in your favor as far as getting out of the lease and getting your deposit back. And if you have a copy of the lease stating electricity was included that will also help

You can sue first of all. In the mean time, relocate and move back into your mom's to get extra funds for the case. Make sure you have all of you information and documents in order, scanning and re-scanning to make sure you might not have overlooked anything. And remain calm

WTF....what kind of stuff is the landlord pulling....personally i wouldnt pay my rent until the problem is fixed.....if the problem still continues.....take matters in your own hands and seek legal help...review your lease to make sure there isn't any underwritten stuff....and keep record of everything and keep complaining to the right people....the landlord knows he is wrong....so dang on grimmy

Find another apartment and get out of your current lease with the help of an attorney.
