He told Joe the next day who then told the athletic director. The athletic director and the president are being criminally prosecuted for not doing what they were legally obligated to do. McQueary is not being criminally prosecuted because he did what was morally wrong, not legally. Paterno was wrong for not taking it into his own hands...
