  • your completly right im a republican... i know im sorry lol but my party really is being dumb by waiting and banking on the mistakes of one person and sitting idely by waiting for the natural turn of politics to come around. the republicans need to help by suggesting solutions they deem appropriate and looking at all the angles of a bill before passing judgement on it because of who wrote it. of course this applies to both parties when you think about it.

  • I *really* hope the National Republican PAC has their way. Suppose they force typically reasonable conservatives who know the law (i.e., Senator Hatch of Utah) to fillibuster over the next year and a half. This will cause the Rebulican Party to completely implode the way the National Republican Party (the Whigs) imploded prior to the War Between the States.

  • Unfortunately, I agree with the previous commentor about how our country has acted like an Empire for the past 8 years, much as Rome did, right before the fall. Right down to the sometimes insane rulers. Like Caligula, they busied themselves emptying our Treasury, breaking the Military, treating them like crap when they come back; Also stretching them too thin. They don't even have enough WATER for God's sake. Sickening. Hopefully it will be better now under the new administration.

  • I think we mistake the fact that these people would come around if they would just listen to reason. They hear - they do not agree. I have yet to understand what it is they really stand for and what the threat to them is if gays marry and minorities prosper. I didnt understand them when they burnt down churches in the south and I dont understand them now. When you ask they call you names and freak - its the crazies.   • it will sound stupid because everyone thinks the american economy was destroyed by republicans but im a conservative in economics i believe in capatilism and the fact that everyone should earn what they get instead of getting a government hand out from a bail out bill, now i understand we couldnt let companies like GM and the banks fail but if it wasnt for liberal bills passed under the bush administration we wouldnt be in this mess. i know it sounds like im crazy but ive done alot of research

You can say it isnt so but look over voting records and you will see that one of the fundamental difference in MOD of parties is this.

  • Pure political hackery. As the judiciary attempts to consider what the law should be, it (unfortunately) becomes a political position. The Republicans should use their authority to attempt to ensure the next justice is a skilled legal scholar who will produce rulings based on the law, not activism. If Congress passes a bad law, it's their role, not the judiciary's, to fix it.

  • It's called a check and balance system for a reason. If Congress passes a bad law, why would they fix it if no one calls them out on it?

    More, if it wasn't for activist judges, we wouldn't have racial equality with the over ruling of bad laws Congress made.

  • The Supreme Court also gave us the Dred Scott decision. There is no guarantee that the individuals on the Supreme Court will be any more enlightened than Congress. The difference is that we can throw out our Congresspeople. Supreme Court justices have their positions for life. Short of impeaching our justices (which I think is unprecedented) and passing amendments, there aren't too many checks on the judiciary.

  • A valid point on their being not enough checks on the Judiciary. I do think there should me more, but that is not a reason not to have active judges. That is a reason for more balances. So my original point stands.

    In reality: A judge who interprets the constitution loosely, interpreting it in a modern context. This led to Miranda Rights, the Right to Privacy, Abortion, Busing, and W's presidential victory among other things.

  • Activist are those who take a relative approach to the constitution. Conservatives believe some issues are better left to the states while "activist" judges make them federal issues.

    Abortion is a good example. Nobody can find written in the written constitution the right to privacy as interpreted by the justices. But it is that right that rationalizes abortion as a federal ly protected right.

    The constitution has been so perverted, it has little meaning these days.

Only a few short years ago, when Bush was nominating Roberts and Alito, the Republicans were threatening to change the rules of the Senate to abolish the filibuster and go to a straight vote. Now they are threatening to filibuster all of Obama's picks. Astounding.
