Pure political hackery. As the judiciary attempts to consider what the law should be, it (unfortunately) becomes a political position. The Republicans should use their authority to attempt to ensure the next justice is a skilled legal scholar who will produce rulings based on the law, not activism. If Congress passes a bad law, it's their role, not the judiciary's, to fix it.

The Supreme Court also gave us the Dred Scott decision. There is no guarantee that the individuals on the Supreme Court will be any more enlightened than Congress. The difference is that we can throw out our Congresspeople. Supreme Court justices have their positions for life. Short of impeaching our justices (which I think is unprecedented) and passing amendments, there aren't too many checks on the judiciary.
